Question 1:
This program will create a Special Power of Attorney. There are
seven different types of documents that can be created with this
software, so you should be sure that you have chosen the correct
one to write.
A Special Power of Attorney will allow you to name a person to take
care of specific things for you. This doesn't need to be a person
licensed to practice law in your state, but anyone you trust to do
these things. You will have the opportunity to identify what you
wish this person to do.
Question 2:
Please enter your full name so it is clear who this document is
for. If you are going to write a Special Power of Attorney for
both you and your spouse you will have the opportunity to do that
in the next question(s).
Question 3:
You can write a Special Power of Attorney for yourself or for you
and your spouse. Generally it is a good idea to include your
spouse if he or she will be available to sign the finished
document and if what you want the attorney to do will affect him or
her as well as you (such as if you are giving the attorney the
power to affect your real estate that has your spouse's name on
it).
Question 4:
If you are including your spouse in this document, his or her name
needs to be clearly specified.
Question 5:
Please enter your address. Include only the number and street in
answer to this question as well as any applicable apartment number.
Question 6:
Please enter the name of the City or Town in which you live. If
you do not live in a City or Town, you can use your post office
address.
Question 7:
You need to specify if you live in a County or Parish so the
finished document can include the name.
Question 8:
Here, you need to identify the name of the County or Parish where
you live.
Question 9:
Please enter the name of the State or Jurisdiction where you live.
Question 10:
You may name anyone that you trust to be your attorney. The
person does not have to be a lawyer. You may also name someone
that does not live in your state, so long as he or she has access
to do anything that becomes necessary.
Question 11:
Please enter the address of the person you are naming as your
attorney. Include only the number and street in answer to this
question as well as any applicable apartment number.
Question 12:
Please enter the name of the City or Town where the attorney lives.
If there is no applicable City or Town, then enter the attorney's
post office address.
Question 13:
You need to specify if the attorney lives in a County or Parish.
If you do not know, then answer "no" to this question.
Question 14:
Here, you need to identify the name of the County or Parish where
the attorney lives.
Question 15:
Please enter the State or Territory where the attorney lives.
Question 16:
This provision gives the attorney the right to collect money for
you and to pay your bills.
Question 17:
This and the following questions deal with your real estate. If
you wish the attorney to have powers concerning your property, then
you can implement those powers by carefully selecting from these
questions. This one allows the attorney to sell, convey or
otherwise give up some right in the property, even if that right
is just to rent the property. You should only use this paragraph
if you wish to give all of the rights listed. If you just want
the attorney to have the power to rent the property then you can
use question 19 for that purpose.
Question 18:
Answering "yes" to this question will give the attorney the power
to mortgage or encumber your real property. Subsequent questions
will allow you to specify a maximum amount by which your attorney
can encumber your property.
Question 19
Here, the attorney is given only the right to collect rents from
your real property.
Question 20:
You need to identify the property that the attorney has the right
to affect. Please enter the number and street address here, along
with any applicable apartment number.
Question 21:
Please enter the name of the City or Town where your property is
located. If there is no City or Town, then you can enter the post
office address for your property.
Question 22:
You need to specify if your property is located in a County or
Parish?
Question 23:
Please enter the name of the County or Parish where your property
is located.
Question 24:
Please enter the State or Territory where your property is located.
If it is in a country other then the United States, please also
enter the name of the country here.
Question 25:
If you have answered the above question or questions so as to allow
your attorney to affect your real property by encumbering it, then
this question will allow you to put a limit on the amount that the
attorney can encumber your property without your further
permission.
Question 26:
This question should be answered "yes" if you wish the attorney to
have the right to affect a specific piece or pieces of personal
property, such as a car or a car and boat. If you wish to give the
attorney the right to affect all of your personal property, then
answer this question "no" and question 28 "yes".
Question 27:
This allows you to name the specific item or items of personal
property that your attorney can affect.
Question 28:
This allows the attorney to affect any and all of your personal
property. If you just wish the attorney to be able to affect a
specific item or items of your personal property, then return to
question 26 and answer that question "yes".
Question 29:
Here, the attorney is given the right to borrow money in your
name. Since you will ultimately be liable to repay the loan, you
can use question 30 to specify the maximum amount of debt that the
attorney can create.
Question 30:
If you have given your attorney the right to borrow money in your
name then it is a good idea to specify the maximum amount that he
or she can borrow. Remember that you will be liable to repay any
monies borrowed in your name.
Question 31:
This gives the attorney full control to run your business.
Question 32:
Please enter the full name of the business that you are allowing
the attorney to manage and control.
Question 33:
Please enter the number and street of your business. You can use
an apartment number or suite number here if appropriate. In the
event that your business has more than one location enter the
address of the main branch.
Question 34:
Please enter the name of the City or Town where your business is
located.
Question 35:
Please enter the State or Territory where your business is located.
If the principal place of your business is in another country then
you can enter the name of that country here.
Question 36:
If there are any other powers that you want the attorney to have,
you can use the next set of questions to designate them. The
program will allow you to designate three additional powers for
your attorney. If you wish to specify more than three, you can do
so by listing more than one thing in answer to the following
questions.
Question 37:
Here, you should list the power that you wish your attorney to
have.
Question 38:
If you wish to have your attorney take care of additional items,
then answer "yes" to this question.
Question 39:
Here, you should list the power that you wish your attorney to
have.
Question 40:
If you wish to have your attorney take care of additional items,
then answer "yes" to this question.
Question 41:
Here, you should list the power that you wish your attorney to
have.
Question 42:
Here, you have the right to specify when the Power of Attorney
will take effect, and when it will end. This question is to be
used when you have a specific date in mind that you wish the Power
to end. The next question will allow you to have the Power end on
the happening of a specific event.
Question 43:
This question will allow you to have the Power of Attorney expire
on the occurrence of a specific event.
Question 44:
This question simply specifies the date when the Power will start.
You should use a date, since in some states it is illegal to have a
Power of Attorney that starts on the happening of a specific event.
If your desire is have the Power start at some specific event, then
contact your lawyer to find out if it will be enforceable in your
state.
Question 45:
Please identify the date when the power of attorney will expire.
Note that the Power of Attorney will automatically expire on that
date without the necessity of further paperwork. However, if you
wish the Power of Attorney to end earlier, you can use the
Revocation of Power of Attorney included in this program.
Question 46:
This question allows the user to designate a specific event upon
which the Power of Attorney will terminate: for example "when I
return from Europe"
Question 47:
All of the questions have now been asked. If you wish to change
any of your answers you can go backwards through the questions by
pressing the "Esc" key. Otherwise the program will compile your
Special Power of Attorney and allow you to preview it, write it to
a file or print it, or any combination thereof.
